Felonies & Misdemeanors

Felony

Felony charges typically involve weapons, drugs, violence, serious physical injury or significant financial harm to society or to a victim.  A felony arrest normally requires the defendant to post high, secured bail before they will be released from prison.  A felony arrest and/or conviction can have devastating lifelong effects, especially if an experienced Criminal Defense Lawyer is not promptly retained to handle your case.

If you are convicted of a felony, either by a guilty plea or a verdict following a trial, the court may be required to impose a period of incarceration, house arrest, probation, a fine, restitution, community service, and mental health and/or substance abuse treatment programs, etc. If you are convicted of felony assault with a weapon, you will serve a lengthy prison term.

Misdemeanor

A Misdemeanor is a crime considered to be less serious than a felony.  Any criminal arrest, however, can have unwanted lifelong effects, especially if an experienced Criminal Defense Lawyer is not promptly retained to handle your case.  Whether a criminal act is charged as a misdemeanor or a felony depends on the seriousness of the offense.

If you are convicted of a misdemeanor, either by a guilty plea or a verdict following a trial, the court may impose a period of incarceration up to one year, probation, “no contact” orders, a fine, restitution, community service, and mental health and/or substance abuse treatment programs, etc.

In Delaware, a criminal conviction stays on a person’s record for life, with few exceptions.
